Welcome to JoyKids Events. These Terms of Service ("Terms") govern your use of our children's event organization services and website. By accessing our services or booking an event with us, you agree to be bound by these Terms. Please read them carefully before proceeding with any bookings or engagements.

1. Acceptance of Terms

By using the services provided by JoyKids Events, located at 19 Eagle St, Brisbane QLD 4000, Australia, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These Terms apply to all visitors, users, clients, and others who access or use our services, whether in person, via telephone, email, or through our website at joykidsevents.com.au.

2. Service Description

JoyKids Events provides professional children's event organization services, including but not limited to:

  • Birthday party planning and execution
  • Themed event design and decoration
  • Entertainment services (performers, magicians, face painters, etc.)
  • Activity coordination and supervision
  • Event photography and videography
  • Custom party packages and consultations

All services are subject to availability and must be booked in advance. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Booking and Payment Terms

3.1 Booking Process

To book our services, clients must provide complete and accurate information including event date, time, location, number of attendees, and specific service requirements. A booking is confirmed only upon receipt of a signed service agreement and the required deposit payment.

3.2 Payment Schedule

A non-refundable deposit of 30% of the total service fee is required at the time of booking. The remaining balance must be paid in full no later than seven (7) days before the scheduled event date. Failure to make timely payments may result in cancellation of services.

3.3 Accepted Payment Methods

We accept payment via credit card, debit card, bank transfer, and approved digital payment platforms. All prices are quoted in Australian Dollars (AUD) and include applicable GST unless otherwise stated.

4. Cancellation and Refund Policy

4.1 Client Cancellations

If you need to cancel your event booking, the following cancellation fees apply:

  • More than 30 days before the event: Loss of deposit (30% of total fee)
  • 15-30 days before the event: 50% of the total service fee
  • 7-14 days before the event: 75% of the total service fee
  • Less than 7 days before the event: 100% of the total service fee (no refund)

4.2 Postponement

Events may be postponed once without penalty if notice is provided at least 14 days in advance and the new date is within six months of the original date, subject to availability.

4.3 JoyKids Events Cancellations

In the unlikely event that we must cancel your event due to circumstances beyond our control (severe weather, illness, etc.), we will provide a full refund or reschedule at your preference.

5. Client Responsibilities

As a client of JoyKids Events, you agree to:

  • Provide accurate information about the event, including the number of children attending, age ranges, and any special needs or allergies
  • Ensure the event venue is safe, accessible, and suitable for the planned activities
  • Obtain all necessary permissions and permits for the event location
  • Provide adequate supervision of children in conjunction with our staff
  • Inform us of any venue restrictions or special requirements at least 7 days before the event
  • Ensure that electricity, water, and other necessary utilities are available if required
  • Provide parking and unloading access for our equipment and staff

6. Liability and Insurance

6.1 Our Insurance Coverage

JoyKids Events maintains comprehensive public liability insurance and professional indemnity insurance. All our equipment meets Australian safety standards, and our staff hold current Working with Children checks.

6.2 Limitation of Liability

While we take every precaution to ensure safety, JoyKids Events is not liable for any injuries, accidents, or damages that occur during events except where such liability cannot be excluded by law. Parents and guardians remain responsible for supervising their children at all times.

6.3 Property Damage

Clients are responsible for any damage to our equipment, props, or costumes caused by negligence or misuse. We are not liable for damage to venue property except where caused by our gross negligence.

7. Conduct and Safety

We reserve the right to refuse service or terminate an event without refund if:

  • Client or guests behave in a threatening, abusive, or inappropriate manner toward our staff
  • The venue is deemed unsafe for our staff or attendees
  • Children are unsupervised to the extent that safety is compromised
  • Alcohol or illegal substances are present in areas where children's activities are taking place
  • The client has provided false or misleading information that affects service delivery

8. Intellectual Property

All content, designs, themes, scripts, photographs, videos, and materials created or provided by JoyKids Events remain our intellectual property. Clients may not reproduce, distribute, or commercially use any of our proprietary materials without written permission.

We retain the right to use photographs and videos from events for marketing purposes unless clients explicitly opt out in writing prior to the event.

9. Privacy and Data Protection

We collect and process personal information in accordance with Australian privacy laws and our Privacy Policy. Client information is used solely for service delivery, communication, and improvement of our services. We do not sell or share personal data with third parties except as required by law or with explicit consent.

10. Force Majeure

JoyKids Events is not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemic restrictions, government orders, strikes, or other force majeure events. In such cases, we will work with clients to reschedule or provide appropriate alternatives.

11. Modifications to Services

While we strive to deliver services exactly as planned, we reserve the right to make reasonable substitutions for entertainers, activities, or materials if necessary due to availability or unforeseen circumstances. Any such substitutions will be of equal or higher quality.

12. Disputes and Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Queensland. We encourage clients to contact us directly to resolve any concerns before pursuing legal action.

13. Changes to Terms

JoyKids Events reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

15. Severability
